Titus Day is Found Guilty Of Embezzling His Client’s Money
Titus Day, Guy Sebastian’s former manager, will remain on bail after being found guilty of stealing more than $600,000 in royalties and performance fees from the pop star.
After nearly a week of deliberation, an NSW District Court jury returned guilty verdicts on 34 counts of embezzlement and acquitted Titus on 13 counts on Thursday. Titus had entered a not guilty plea to the charges.
Crown prosecutor David Morters, SC, requested detention under new bail laws that went into effect last week. It states that offenders who “will be sentenced to imprisonment to be served by full-time detention” must be denied bail unless exceptional circumstances are established.
Titus returned to court on Friday when Judge Timothy Gartelmann denied the Crown’s application. He was not convinced of the certainty of full-time imprisonment “based on the limited evidence currently before the court in determining this application.”
The formal manager’s bail conditions require him to live at his Sydney address, surrender his passport, and report to Waverley police every Wednesday.
Dominic Toomey, SC, the formal manager’s barrister, said that for the new provision to apply, the judge would have to be satisfied that Day “could not even be considered for an intensive correction order,” which is a sentence served in the community.
