Sami Chokri Law Suit & Court Case Explored
Musicians Sami Chokri and Ross O’Donoghue sued Ed Sheeran in March 2022, alleging that “Shape Of You” infringes on “certain lyrics and phrases” from their 2015 song “Oh Why.”
The music licensing organization PRS for Music has prohibited Ed Sheeran and his co-writers, Steven McCutcheon and John McDaid, from receiving an estimated £20 million in royalties from “Shape of You” performances or broadcasts.
Ed and his co-writers petitioned the High Court of Justice in May 2018, demanding that the court determine that they had not infringed on Sami and Ross’s copyright.
Sami and Ross then filed their claim for “copyright infringement, damages, and an account of profits in relation to the claimed violation,” which was filed two months later.
According to the court, Ed had “neither knowingly nor unconsciously stolen” Sami’s song, which issued his ruling on April 6, 2022.
While there were “similarities between the one-bar phrase,” the court found that “differences between the relevant sections” of the songs were “compelling evidence” that Ed’s song’s “Oh I’ phrase” came from “sources other than Oh Why.”
