Ryan Duke Trial Update

Ryan Duke’s trial was originally scheduled to begin on April 1, 2019, however, it was postponed when the Georgia Supreme Court approved the defense’s request to have the state pay for expert witnesses and investigators, which had been opposed by the state.

When asked if the state should supply cash, attorney Ashleigh Merchant responded that it should even if she and her husband were representing him pro gratis and not as a state-appointed attorney.

Duke had fired his first public defender, who had represented him. His counsel claimed that he lacked the financial means to hire expert witnesses in DNA testing, false confessions, and psychology. They contended that he would not receive a fair trial if they were not present.

The issue was taken up by the court in February 2020 when Tift Judicial Circuit Superior Court Judge Bill Reinhard consented to hear the appeal after previously denying it on two occasions.
