Reproductive rights activists are outraged after a woman was arrested for self-abortion.  It is unclear if Herrera is charged with having a self-induced abortion or of assisting another person in having an abortion.

According to the USA today, a small crowd gathered outside the jail on Saturday morning to demand Herrera’s release. The arrest was described as “inhumane” by Rockie Gonzalez, founder of Frontera Fund, the nonprofit abortion access fund that organized the protest.

He also released a statement stating that “criminalizing pregnant people’s choices or pregnancy outcomes is not fair. It takes away people’s autonomy over their own bodies and leaves them with no safe options when they choose not to become a parent.”

According to NPR, state legislation enacted in 2021 prohibited abortions in Texas for women as early as six weeks pregnant. It has significantly reduced the number of abortions in the state.

The legislation defers enforcement to private persons, who can sue doctors or anybody else who assists a woman in obtaining an abortion. However, certain states continue to maintain laws that make self-induced abortion illegal.

And “there have been a number of convictions here and there throughout the years,” Vladeck said.

Another Texas legislation prevents doctors and clinics from prescribing abortion-inducing medicines beyond the seventh week of pregnancy.

However, medication abortions, according to Vladeck, are not regarded as self-inflicted under federal Food and Drug Administration laws.
