Kenneth Faried adds 17 points in a win over Mavericks
Kenneth Faried hit 7-of-8 field-goal attempts on his way to 17 points, eight rebounds, one assist, one steal, and one block in the Rockets 120-104 win against Dallas Monday night.
Fantasy Impact:
Faried has been a great find for Houston averaging 17.4 points, 10.6 rebounds, and one block per game over his last seven games. He ranks just outside the top 60 over the last two weeks of play. The bad news, he will be looking at a reduction in minutes when Clint Capela returns after the all-star break. He is a fine play Wednesday night but if you can sell high anywhere the time is now.
Adopted from Fantasy News
Louisville basketball fans may remember Kenneth Faried as the fierce rebounder who led Morehead State to a shocking upset over the Cardinals in the 2011 NCAA Basketball Tournament.
Faried went on to the NBA’s Denver Nuggets, which paid him about $1.4 million his first season. But he left behind a daughter whom he fathered when he and the girl’s mother were students at the public university in Rowan County.
Now the Kentucky Supreme Court will hear arguments Wednesday on how much Faried – and high-income individuals like him – should pay in support for a child who never lived with him.
In the first case of its kind in Kentucky, the court must decide how to define the “reasonable needs” of children – the standard in child-support orders – when their parents never lived together or had a lifestyle in common.
The attorney for the girl’s mother, Rebekah McCarty, said Kyla, who is now 5 and lives with her mother in modest circumstances in Owingsville, Ky., should not be expected to live at “a minimal level of comfort” while her father is “living a life of luxury.”But Faried’s lawyer said it is unfair to require him to pay for a lifestyle his daughter does not live.
A Bath Circuit Court judge in 2013 ordered Faried to pay $4,250 a month, slightly less than the $5,000 McCarty said she needed to supply a safe and stable home, nutritious meals, and a good education for her daughter.
Faried appealed, saying the award was excessive.
In a 3-0 ruling last May, the state Court of Appeals agreed, noting the amount was nearly three times the $1,547 that McCarty listed as her entire monthly expenses.
Writing for the court, Judge Christopher Nickell cited what is known as the “three pony rule” – the notion that no child, no matter how wealthy one of their parents, needs to be provided more than three ponies.
The court said the trial judge, Beth Lewis Maze, seemed to have made up the child-support award out of “whole cloth” and was attempting to “micromanage the rearing of Kyla” based on the court’s own estimate of her costs and needs, rather than the amount required in rural Bath County.Child support in Kentucky is usually based on the family’s standard of living – and guidelines based on the parents’ income.
But the guidelines only go up to $175,000, meaning they had no role in this case. And Kyla’s parents had never lived together, either before or after she was born. After her birth, McCarthy left school to care for her, while Faried continued his education, set the modern-day record for rebounds by a college player and signed with the Nuggets.
McCarty and Kyla moved in with McCarty’s parents, which the Court of Appeals said saved her money.
“A child support order must be rooted in reality and bear a reasonable relationship to the evidence,” Nickell wrote. “Hopes, dreams and plans simply are not evidence of actual expenses and reasonable needs.”
He also noted that McCarty met a new boyfriend and had two more children with him, and he said that she was actually requesting support from Faried for all five.
But in her appeal to the Supreme Court, McCarty’s lawyer, Eileen O’Brien of Lexington, said the Court of Appeals erred in assuming “the lifestyle of the parent with the least resources represents the child’s reasonable needs.”
If the ruling stands, O’Brien says, it would result in an “unconscionable precedent for out-of-wedlock children who are ever afforded an opportunity to enjoy the lifestyle … that should be expected when one parent is of substantial needs.”
Faried grew up in desperate poverty in Newark, N.J., raised by a single mother battling lupus, according to news accounts. And his lawyer, Janice Lintner of Louisville, says in court papers that he has been generous with Kyla and his own family.
In a brief, Lintner said he’s paid for his daughter’s health care, clothing and expenses, taken her to Disney World, and flown her back and forth from Kentucky to Colorado. She said he also supports his impoverished parents and a brother who lives with him.
Still, one of the Court of Appeals judges who ruled in his favor suggested he could do more.
While the law supports Faried, Judge Sara Walter Combs wrote in a concurring opinion, “he remains free to be as generous as his conscience dictates.” And she said she hopes “the better angels of his nature” recognize that.
Faried now would seem like he has the money to do so.
Under a four-year contract extension worth $50 million negotiated for him in 2014, his pay this season is $11,235,955.
