Guyger fatally shot Jean in his Dallas residence while she was still in uniform in September 2018.
She was a former Dallas cop who was sentenced to prison for the murder of Botham Jean. She wanted her murder conviction overturned, but she was denied for the second time by a higher court.
Is Amber Guyger In Jail? What Happened?
Yes, Amber Guyger is in jail as of the moment.
Guyger had just gotten off her work as a Dallas cop when she fatally shot Jean on Sept. 6, 2018, after mistaking his apartment for her own, which was one level below.
During her trial, she stated that she believed Jean was an intruder intent on murdering her.
Jean’s younger brother, Brandt Jean, 18, told Guyger during his sentencing hearing that he had forgiven her and was given permission by Judge Tammy Kemp, who presided over the trial, to hug her.
Guyger received a hug and words of support from Kemp.
Kemp told The Associated Press that because the trial was over, she felt her actions were appropriate. Guyger allegedly informed her she didn’t know how to seek God’s pardon.
How Much Time Did She Get? Sentence Update
Guyger was sentenced to ten years in prison; however her term could be reduced if her conviction is overturned.
She is currently incarcerated in the Texas Department of Criminal Justice’s Mountain View Unit in Gatesville, some 130 miles south of Dallas.
She requested a lesser charge and a new hearing for her punishment after her conviction.
According to court filings, Guyger maintained that the evidence is legally insufficient to prove she committed murder.
The court decided that the evidence supported the murder conviction. During her testimony, Guyger stated that she meant to kill Jean.
Guyger also said that believing she was in her own home was an “error of fact.” The “error of fact” in criminal law, according to the court, is not the same as that case.
