Rittenhouse testified that the man he shot and killed, Joseph Rosenbaum, had threatened him and said he came out of the car and ambushed him before the shooting.
Later in his testimony, he stated that he believed Rosenbaum tried to take his gun, adding that if he had taken Kyle’s gun, he would have used it against Kyle and killed him.
In court afternoon, defence attorney Corey Chirafisi stated that the defence is filing a motion for a mistrial with prejudice, claiming that the prosecutor, ADA Thomas Binger, engaged in what amounts to prosecutorial overreach.
The Judge stated that the motion would be taken under advisement.
